Terms of Service

These Terms of Service ("Terms") govern your use of epayvista.com, the ePayVista WooCommerce plugin, and related services (the "Services") provided by ePayVista ("we", "us"). By installing the plugin or using the Services, you agree to these Terms.
1. The Services
ePayVista provides non-custodial payment gateway software that enables merchants to accept customer payments and receive settlement in digital assets (such as USDC or USDT) at a wallet address the merchant configures. ePayVista is software infrastructure; we are not a bank, money transmitter, custodian, or escrow agent, and we never take possession of merchant funds.
2. Eligibility and merchant responsibility
You must be at least 18 years old and able to form a binding contract. You are solely responsible for ensuring that your products, services, marketing, and use of the Services comply with all laws and regulations applicable to you and your customers, including consumer-protection, tax, product-safety, import/export, and financial regulations in every jurisdiction in which you operate or sell. ePayVista does not provide legal advice and approval to use the software does not constitute a determination that your business is lawful in any jurisdiction.
3. Fees
The plugin is free to install. A flat fee of 1% is applied to each transaction processed through the gateway, deducted automatically at settlement. Network (blockchain) fees, where applicable, are borne by the parties to the transaction. Fees may change prospectively with notice posted to this site.
4. Settlement and custody
Settlements are pushed to the wallet address you configure. You are solely responsible for the accuracy of your wallet address and the security of your keys. Transactions on public blockchains are irreversible; we cannot recover funds sent to an address you supplied, whether correct or not. Digital-asset values may fluctuate; you bear all market, network, and protocol risk associated with receiving and holding digital assets.
5. Refunds and customer disputes
Because settlement is irreversible, any refund, return, or customer-service policy is between you and your customer, funded and executed by you. You agree to maintain and honor a clear refund policy appropriate to your business and to handle customer disputes in good faith.
6. Prohibited use
You may not use the Services for any activity that is unlawful where you operate, including fraud, sale of illegal goods, money laundering, terrorist financing, or evasion of sanctions. We may suspend or terminate access to the Services for violations of these Terms.
7. Intellectual property
We grant you a limited, non-exclusive, non-transferable license to install and use the plugin for accepting payments on stores you operate. You may not reverse-engineer, resell, or redistribute the software except as permitted by law.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR TRANSACTION WILL SETTLE WITHIN ANY PARTICULAR TIME.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPAYVISTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DIGITAL ASSETS, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless ePayVista from claims, damages, and expenses (including reasonable legal fees) arising from your products, your store, your use of the Services, or your violation of these Terms or applicable law.
11. Changes and termination
We may modify these Terms prospectively by posting an updated version with a new "Last updated" date. We may modify or discontinue the Services at any time. You may stop using the Services at any time by deactivating the plugin.
12. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles, and any dispute shall be brought exclusively in the state or federal courts located in New York County, New York. For merchants contracting with our United Arab Emirates operations, these Terms are instead governed by the laws of the Emirate of Dubai and the applicable federal laws of the UAE, with disputes brought exclusively in the courts of Dubai. In each case you and ePayVista waive any objection to venue in those courts.
